Department of Public Health Files Emergency Rules

Mandating COVID-19 Testing in Long-Term Care Facilities

•June 3, 2020•
Today, the Illinois Department of Public Health (IDPH) filed emergency rules mandating long-term care facilities comply with infection control practices, including testing all residents and staff for COVID-19. Each facility will be required to develop and implement a testing plan to better protect vulnerable residents and ensure no facility is shirking its responsibilities for those in their care.
“Nursing home residents are at higher risk for infection, serious illness, and death from COVID-19,” said IDPH Director Dr. Ngozi Ezike. “Testing residents and health care staff is important to help keep COVID-19 out of facilities if the virus is not there, detect cases quickly – especially among individuals who are asymptomatic, and stop transmission. While many facilities are working with IDPH and their local health departments to help keep residents safe, we cannot rely on voluntary compliance alone, and this additional regulatory authority will help ensure swift action.” Read More

What Can We Learn from The Big Disruption?

News Progress Posted on May 27, 2020 by webmasterMay 27, 2020

Since I live in a small out-of-the way county that has had one reported case of COVID-19, a second recently rumored, I have been hesitant to write about The Big Disruption in our lives. I am obviously not sharing the valiant struggles of nurses and their associates, at the side of infected patients gasping for air, most in densely populated urban centers like Chicago, or in nursing homes.
I will not gainsay or second-guess decisions made thus far by top elected officials, who are up to their eyeballs in alligators. My thoughts are about what we might learn for the future from our plight of the present.
As is typical when crises pop up, often unanticipated or undetected until too late, there has been a food fight of finger-pointing among elected officials. Governors are blaming the president. Mr. Trump is pointing his finger at everyone and anyone but himself. Congress is playing dumb, as if, “We didn’t know nuttin’.”
Yet some members of Congress knew enough to dump their stocks before the market tanked, without letting you and me in on the pending crisis. Maybe we could have been ahead of the curve instead of trying to flatten it. Read More

Measures addressing aggravated battery of retail workers, disability leave for public employees and unionization of employees in the horse racing industry found their way into a COVID-19-response bill this week at the Capitol.
The aggravated battery language in Senate Bill 471 was a subject of heated debate in the House on Friday, which often turned into a philosophical discussion as to whether “penalty enhancements” were worthy public policy.
Rep. Jay Hoffman, D-Swansea, who sponsored the bill, claimed that “penalty enhancement” was not the correct characterization of the measure, because “the individual action that would be a crime doesn’t exist. You can’t enhance something that didn’t exist previously.”
Strictly speaking, the bill amends the “aggravated battery” section of law by adding the crime of assaulting or battering a retail worker who is fulfilling duties such as relaying health care or safety regulations from an employer or public health agencies. Read More
